The Law Society notes the clear decision of the Australian people expressed on Saturday in the Voice referendum. The debate over the past 12 months has raised many difficult issues, and has no doubt been the source of considerable distress for many people. I want to express my support, particularly for Indigenous members of the Law Society, as well as all the members of our Indigenous Issues Committee. Irrespective of the result, the Law Society will continue its advocacy, in partnership with Aboriginal and Torres Strait Islander people and communities, in pursuit of better outcomes and a more just legal system for the first peoples of Australia. 2023 Law Society Council Election – Voting
Solicitor members will have received an invitation to vote electronically in the 2023 Law Society Council election. The email includes a link to the electronic voting form. Eight candidates have been nominated to fill three “Councillor” Unreserved Positions (each for a three-year term). Solicitor members must ensure their vote is received before the ballot closes at 2.00pm (AEDT) on Monday, 23 October 2023. Enquiries should be directed to secretary@lawsociety.com.au. Tax Practitioners Board Appointments
Ms Simone Carton, Mr Phillip Davies and Professor Kerrie Sadiq have been appointed by the Government to the Tax Practitioners Board. The Tax Practitioners Board is the national body responsible for regulation of tax practitioners. More information on the appointments is available here.

Trading names to be retired from the Australian Business Register
From 1 November 2023, ABN Lookup will no longer display trading names and will only display registered business names. The Australian Business Register stopped collecting or updating trading names on 28 May 2012.Transitional arrangements which have applied to allow the business community time to register business names are due to expire on 31 October 2023. Any business still using a trading name should ensure a business name is registered prior to this date. More information on the transition is available here.

Farewell Ceremony for the Hon. Justice Robert Beech-Jones
Justice Robert Beech-Jones will be retiring as Chief Judge at Common Law and a judge of appeal to take up his appointment as a Justice of the High Court of Australia. A formal ceremony to mark this occasion will be held in the Banco Court, on level 13 of the Law Courts Building, on Thursday 19 October at 9.15am. The ceremony will be followed by morning tea in the Banco Court foyer. The above public ceremony will be notified in the Law List on the prior Tuesday and Wednesday and also on the day of the ceremony. The ceremony will also be livestreamed with the link being posted on the Supreme Court website prior to the ceremony.

Changes to concession for unoccupied land intended to be owner’s principal place of residence
Effective from 1 July 2023, changes in legislation permit an extension to the period for which unoccupied land may be treated as an owner’s principal place of residence, from four land tax years to up to six years, in certain circumstances. The extension can be applied retrospectively to relevant exemptions that ended on or after 31 December 2019. A Commissioner’s Practice Note has been published.

Reissued Supreme Court Practice Note SC EQ 4 - Corporations List
The reissued Practice Note has a commencement date of 18 October 2023. The changes begin at paragraph 24 and pick up the Practice Note – Harmonisation in schemes of arrangement as developed by the Committee for the Harmonisation of Rules of the Council of Chief Justices of Australia and New Zealand.
