Survey – A Capability Framework for the Legal Profession
The Law Society of NSW is seeking your feedback on a project to develop a Capability Framework for the legal profession. The framework will serve to identify, nurture, and leverage the capacities and proficiencies of legal practitioners across a wide range of roles, sectors, practice areas and levels of expertise. This short anonymous survey will take you approximately three to five minutes to complete and will assist us to review and validate initial findings. Click here to complete.

For all private law practices with Solicitor or Life Members –steps to register participation in, or exemption, from the upcoming 2024-2025 Scheme year
Each private law practice’s Scheme Co-ordinator principal should have received an email from the Law Society about the upcoming 2024-2025 Scheme year, which commences on 22 November 2024. Scheme Co-ordinators are asked to do two things.
- By 4 October - please ensure their law practice, legal practitioner and Solicitor Membership details recorded with the Society are up to date; and
- From 10 October - make their law practice’s application for registration of participation in, or exemption from the Scheme via the online Scheme portal. If you have any questions or would like assistance accessing the online Scheme portal, please contact our friendly Scheme Administration Team on 02 9926 0189, or email scheme@lawsociety.com.au.

Law Society Council Election – Reminder
On Tuesday, 24 September 2024 an Invitation to Vote in the 2024 Law Society Council election was sent by email to Solicitor Members who had provided email addresses for communication purposes. The Invitation to Vote contains a unique voting link, which is personal to the recipient and must not be shared with, or forwarded to, anyone else. Voting closes on Monday 21 October 2024 at 2.00pm. Members are encouraged to consider voting online to ensure your vote is received on a timely basis. Information about election candidates can be found here.

Appointment of his Honour Judge Andrew Coleman SC
His Honour Judge Andrew Coleman SC has been appointed to the Supreme Court of New South Wales to sit in the Common Law Division. A formal ceremony to mark this occasion will be held in Banco Court, on level 13, on Tuesday 1 October 2024 at 9.15am. The ceremony will be followed by morning tea in the public foyer of Level 13 at the Phillip Street end. The above public ceremony will be notified in the Law List on the prior Friday and Monday and also on the day of the ceremony. The ceremony will also be live-streamed with the link being posted on the Supreme Court website prior to the ceremony.

Submission of the week: youth crime and safety in regional and rural communities
This week we are highlighting our recent submission on community safety in regional and rural communities, particularly in light of systemic factors contributing to youth crime. We urged the Inquiry to explore and identify opportunities to invest in community-led and culturally appropriate family and community-building approaches in alignment with the National Agreement on Closing the Gap. Indexation of damages payable for non-economic and economic loss
Damages payable for non-economic and economic loss under the Motor Accidents Compensation Act 1999 and the Motor Accidents Act 1988 are indexed on 1 October each year in line with the Total Average Weekly Earnings (for full-time adults in NSW) published by the Australian Bureau of Statistics. The maximum amounts under the Motor Accidents Compensation Act 1999 are adjusted in the Motor Accidents Compensation (Determination of Loss) Order 2024 and this is now published on the NSW legislation website. Note, the maximum amounts under the Motor Accidents Act 1988 will be adjusted in the Motor Accidents (Determination of Non-Economic Loss) Order 2024. This Order is yet to be published on the NSW legislation website, however further communications will be issued when this occurs.

Indexation of weekly statutory benefits
Weekly statutory benefits payable under the Motor Accident Injuries Act 2017 are indexed on 1 April and 1 October each year. For 1 October 2024, the number to be used to vary weekly statutory benefits is 1.021. The Motor Accident Injuries (Indexation) Amendment Order (No 2) 2024 has been published on the NSW legislation website.

Indexation of legal costs and medico-legal fees
The maximum costs for legal services and maximum fees for medico-legal services have been indexed in line with the Consumer Price Index for the period starting 1 October 2024. The method of indexation is prescribed in Schedule 3 to the Motor Accidents Compensation Regulation 2020 for the 1999 CTP Scheme, and in Schedule 3 to the Motor Accident Injuries Act Regulation 2017 for the 2017 CTP Scheme. The maximum fees for the period starting 1 October 2024 will be published on the SIRA website by 1 October 2024. Further communications will notify stakeholders of this update.

Reminder: Agreements for sale of land of $20 million+
From 8 October 2024, Revenue NSW will require agreements for sale of land with a dutiable value of $20 million or more to be lodged via eDuties. The requirement is based on the date of lodgement, not the date of the agreement. Read more in the August 2024 EDR update.
