2024 Forbes Lecture on 31 July
The 2024 Forbes Lecture will be presented by Daniel Yazdani on Wednesday 31 July 2024 in the Banco Court, Level 13, Queens Square Law Courts Building commencing at 5:15pm. The Lecture is entitled “Francis Forbes and the Parable of the Gown and Wig: A History of Legal Dress in New South Wales”. The Lecture will be chaired by Dr Simon Chapple SC, Secretary of the Forbes Society. Treatment of capital gains tax in bankruptcy
A recent decision in Robson as trustee for the bankrupt estate of Lanning v Commissioner of Taxation [2024] FCA 720 has confirmed the Inspector-General in Bankruptcy’s approach that a trustee in bankruptcy is answerable as taxpayer for the payment of tax on any income, profits or gains they derive in their representative capacity. The Inspector-General has acknowledged this approach is a change to past practices and has issued guidance on the treatment of CGT in bankruptcy available here.

FAR implementation for insurance and superannuation entities
The Australian Prudential Regulation Authority (APRA) and the Australian Securities and Investments Commission (ASIC) have published new information to help the insurance and superannuation industries prepare for the commencement of the Financial Accountability Regime (FAR). The FAR takes effect for these industries from 15 March 2025. Accountable entities should ensure sufficient time to comply with the FAR. Guidance materials are available on APRA’s website here. Reissued Practice Note SC Gen 17 – Supreme Court Representative Proceedings ('Class Actions')
On 24 July 2024, the Chief Justice reissued Practice Note SC Gen 17, with a commencement date of 1 August 2024. The revised Practice Note updates the practice that will apply to representative proceedings under Part 10 of the Civil Procedure Act 2005 (NSW) commonly described as class actions. Agreements for sale of land of $20 million or more
To reduce risk to EDR clients, in the coming months, Revenue NSW will transition to requiring agreements for the sale of land with a dutiable value of $20 million or more to be lodged via eDuties for assessment. Exemptions and concessions will not be affected. More details will be provided in the coming weeks.
