Survey – A Capability Framework for the Legal Profession
The Law Society of NSW is seeking your feedback on a project to develop a Capability Framework for the legal profession. The framework will serve to identify, nurture, and leverage the capacities and proficiencies of legal practitioners across a wide range of roles, sectors, practice areas and levels of expertise. 2024 Law Society Council Election – Voting
Solicitor members will receive an email this week inviting them to vote electronically in the 2024 Law Society Council election, which includes a link to the voting form. 14 candidates are nominated for six positions: two Councillor Reserved Positions (City, Government) and four Councillor Unreserved Positions. Members can vote electronically or via a paper ballot but are encouraged to vote online to ensure their vote is counted before the 2:00 PM (AEDT) deadline on Monday, 21 October 2024. Supreme Court Bicentennial Concert
Members of the Law Society of NSW are invited to the Supreme Court Bicentennial Concert, which will be held on Friday, 1 November 2024 at 7.00pm in the Sydney Conservatorium of Music. The programme, curated by the conductor of the Sydney Lawyers Orchestra, Thomas Jones, interprets the 200-year history of the Court through the works of composers such as George Palmer, Guiseppe Verdi, Henry Tate and Ludwig Van Beethoven. They will be joined by guest soprano Ellen McNeil and the New South Wales Bar Choir. All tickets are general admission and cost $40. Purchase your tickets from the Conservatorium’s website.

John Hennessy Legal Scholarship - Applications close soon
The Law Society of NSW encourages all public sector and community legal centre solicitors to apply for the John Hennessy Legal Scholarship. The scholarship covers travel, study and other approved expenses up to a maximum value of $10,000 for those interested in undertaking a research project into legal systems in another jurisdiction or undertaking further study. Submission of the week: Reviewing the NSW Reconstruction Authority Act
This week we are highlighting our submission to a review of the NSW Reconstruction Authority Act 2022 (NSW), about which the Law Society gave further evidence at a recent parliamentary hearing. While we acknowledge the need for the Government to act quickly and effectively in responding to natural disasters, we suggest that the powers of the Minister should be subject to reasonable safeguards including clarity, transparency and proportionality. Registered tax agents
All Law Society members who are also registered tax agents have been requested by the Tax Practitioners Board (TPB) to update their TPB profile to record their Law Society membership. This will assist the Law Society to maintain its accreditation as a recognised professional association.

Allocation of professional firm profits – ATO audit risk guidelines applicable to all arrangements from 1 July 2024
Practical Compliance Guidance 2021/4 (PCG) outlines the ATO’s approach to assessing tax risk associated with income splitting schemes by professionals through practice entities, and the compliance attention that will apply. The PCG applies to “individual professional practitioners” in a wide range of firms including lawyers. Transitional provisions in the PCG which allowed existing arrangements as at 1 July 2022 to continue under the previous guidance came to an end on 30 June 2024.

Supreme Court (Amendment No 435) Rule 2024
On 9 September 2024, the Supreme Court Rules Committee approved Amendment No 435 to the Supreme Court Rules 1970. The object of this rule is to make consequential amendments following the commencement of the Industrial Relations Amendment Act 2023, which re-established the Industrial Relations Commission in Court Session. The rule commenced on 13 September 2024 and is available to read here.
