The Law Society’s role in providing respectful and robust advocacy has positioned us as a trusted source of advice for government. At this week’s Drug Summit in Sydney, we will be advocating for increased availability of services, underpinned by the understanding that drug misuse is a health and social issue. We have advocated successfully for the expansion of Drug Courts and the Magistrates Early Referral into Treatment program, and we will continue to encourage the Government to make further investments in these and other diversionary programs. Increase in impersonation scams in law practice bank accounts
The Law Society Trust Accounts Department has seen a significant escalation in scammers calling, emailing or messaging lawyers and pretending to be from their bank. Their goal is to steal money from the law practice’s office and trust accounts. These scammers may claim to be from the bank’s fraud department and represent that they are investigating a compromised account or suspicious transaction. The scammers use technology to make it appear as if the call is coming from the bank’s phone number. Learn how to spot the scam.

AML/CTF webinars
We are pleased to deliver two on-demand recordings complimentary to the legal profession, featuring panel discussions on anti-money laundering and counter-terrorism financing (AML/CTF). These webinars were broadcast earlier this month, but viewers who missed it can now watch it on-demand by registering here. Attendees will hear an expert panel discuss upcoming AML/CTF reforms in Australia, as well as experiences and lessons from AML regimes in the United Kingdom and New Zealand. Both on-demands will be suitable for a range of audiences, from early career lawyers, staff who will need to engage with the day-to-day management of AML/CTF compliance, to senior lawyers and principal practitioners.

Submission of the Week: Mandatory guardrails for AI in high-risk settings
We made a recent submission providing input for a submission by the Law Council of Australia to the Department of Industry, Science and Resources, supporting mandatory guardrails in high-risk AI settings. The submission emphasised a principles-based approach to defining high-risk AI, which allows for flexibility and adaptability. Key recommendations included establishing clear accountability processes, implementing robust risk management, protecting data quality and provenance, conducting rigorous performance testing and monitoring, enabling meaningful human oversight, and ensuring transparency with end-users. The statutory review of the Federal Circuit and Family Court of Australia Act 2021 (FCFCOA Act) commenced on 2 September 2024.
As part of the review, a public online consultation was recently launched and is open until Thursday 12 December 2024. People who interact with the FCFCOA (Division 1) and/or the FCFCOA (Division 2) are encouraged to share their experiences of the impact of the structural reforms via the online survey.

Changes to the Foreign Resident Capital Gains Withholding (FRCGW) regime
The Treasury Laws Amendment (2024 Tax and Other Measures No 1) Bill 2024 passed Parliament on 28 November 2024. The Bill amends the FRCGW regime by removing the current $750,000 threshold and increasing the withholding rate from 12.5 per cent to 15 per cent. The amendments are likely to commence on 1 January 2025, provided the Bill has received assent by that date.
