Easter is often regarded as being symbolic of new beginnings. I hope you returned from the short break last week refreshed and invigorated. But let’s not pretend that a few days off is enough to ease the exhaustion that can all too easily overtake many solicitors, even if they are vigilant about wellbeing. This is one of the reasons why the health and wellbeing of the profession is one of my President’s Priorities for 2024. As I said in my speech at the Opening of Law Term Dinner, a sizeable proportion of lawyers feel concerned about access to mental and physical health services, and we want to remove these barriers. Failure to apply for a Director ID is a criminal offence
ASIC has brought its first action against a director for failing to have a director identification number (director ID). See the ASIC media release here. All directors of Australian companies are required by law to have a director ID. Failure to do so is an offence under section 1272C(1) of the Corporations Act 2001 (Cth). Directors appointed before 4 April 2022 should have applied for and now have their director ID. From 5 April 2022, intending new directors must apply for their director ID before being appointed. The Australian Business Registry Service (ABRS) provides guidance on director ID obligations. Please visit the website for more information.

Sydney Drug Court Expansion
Amendments to the Drug Court Regulation commenced on Friday 29 March 2024. The amendments increased the catchment area of the Sydney Drug Court. Eligible LGAs now include Bayside, Burwood, Canada Bay, City of Sydney, Georges River, Hunters Hill, Inner West, Lane Cove, Mosman, North Sydney, Randwick, Ryde, Strathfield, Waverley, Willoughby, and Woollahra.

Treasury Laws Amendment (Foreign Investment) Bill 2024 (Cth)
The Bill passed on 27 March 2024. Revenue NSW has published an interim message on its website about the potential impact of the legislation on NSW surcharge purchaser duty and surcharge land tax, which is available here.
