Beware of solicitor liability for hearing allocation and hearing fees
|
Regulation 9(3) and 10(3) of the Civil Procedure Regulation 2017 (NSW) operate to hold solicitors jointly and severally liable for hearing allocation and hearing fees. Should solicitors wish to avoid liability for a hearing/allocation fee, it is open to them to take precautions, including those outlined here.

The bulletin details Appeal Decisions of interest between November 1 and December 14, 2021 and covers NSW Court of Appeal Decisions, Australian Intermediate Appellate Decisions, Asia Pacific Decisions and International Decisions.

Appointment of The Honourable Justice Andrew Bell,
Chief Justice of New South Wales
|
Justice Andrew Bell has been appointed as Chief Justice of the Supreme Court of New South Wales. A formal ceremony to mark this occasion will be held in Banco Court, on Level 13, at 9:15 AM on Monday 7 March 2022. The ceremony will be notified in the Law List on Thursday 3 March, Friday 4 March and Monday 7 March 2022.

The Asian Australian Lawyers Association NSW Branch and the Women Lawyers’ Association of NSW are seeking solicitor participants for an online survey and focus group sessions addressing barriers to career progression faced by culturally diverse solicitors. Local Court update
Please see the attached Chief Magistrate’s Memorandum No. 27A – COVID -19. This memo includes two changes: a new section 5.1, which states that in-person appearance may be required where directed by the court in matters other than defended hearings and finalisation of sentencing and a removal of reference to COVID-Safe check in, which is no longer a requirement of the Memo.

Children's Court update
The President of the Children’s Court has updated the Children’s Court’s Public Notice no. 13 to reflect the change in the government’s position in relation to face coverings. Paragraph 23 now states: All persons on court premises are encouraged to wear a fitted face covering unless otherwise determined by the judicial officer hearing the case. The updated Public Notice has been published on the Children’s Court’s website.

This Policy commences on 18 February 2022. It replaces the COVID-19 Pandemic Arrangements Policy made on 1 December 2021. Read more.

Law Society building reopening
The Law Society building reopened today, Monday 28 February 2022. The Society recognises COVID-19 vaccination is an important tool for maintaining the health and wellbeing of its employees and the wider community, and is committed to providing a safe workplace. Anyone entering the Society’s 170 Phillip Street premises is required to be fully vaccinated as a condition of entry to the building. Evidence of vaccination can be provided by displaying your COVID-19 Digital Certificate, which can be accessed via the Service NSW or Express Plus Medicare smartphone apps.
