PRESIDENT'S MESSAGE
NSW leading the way with reforms – second stage discussion paper to be released at the end of the year

Last week’s online Thought Leadership event on national defamation reforms with NSW Attorney General Mark Speakman SC MP and defamation law experts Jim Micallef and Sophie Dawson was well received, providing a comprehensive analysis of both the intent and potential impact of the reforms. The Attorney General foreshadowed that while it would be ideal for the new laws to commence in all jurisdictions on the same date, NSW reserves the right to move to enact the laws when there’s a critical mass, to avoid an unacceptable delay. Mr Speakman signalled that the discussion paper on the second stage of reforms will be released by the end of this year, with the subsequent legislation to be ready in mid-2022. Continue reading >

Impact of COVID-19 on CPD compliance

Given the extraordinary circumstances surrounding COVID-19, the Law Society understands that solicitors may need to complete more than five CPD units through private study of audio/visual material. This means that for the 2020-21 CPD year, we will not enforce the five-unit cap on private study of audio/visual material. All other requirements under the CPD rules must be satisfied unless an exemption or extension of time is granted. Further information.

Court of Appeal
The Honourable Justice Bell, President of the Court of the Appeal, has issued a note to practitioners in respect of hearings in the Court of Appeal this year. Although some limited hearings of trials are now occurring in the Supreme Court in person, the President of the Court of Appeal has indicated that, absent exceptional circumstances, appeals in the Court of Appeal will continue to be heard remotely for the time being. Practitioners engaged in appeals listed for the rest of this year should proceed on that basis.

Claim Cost Disclosures under the Motor Accidents Injuries Act 2017 to be lodged via the online DRS Legal Portal has launched and is now live. Register here for training.

More documents available as electronic dealings in NSW
NSW Land Registry Services has announced that from 7 September 2020, an extra 26 Real Property Act dealings will be available for lodgement as electronic dealings, without needing to attach a paper form as is the current process under the temporary COVID-19 residual lodgement (C-19 RL). New guidance will also be provided on the Registrar General’s Guidelines. Read more.

Sitting arrangements: Christmas New Year period 2020/21
In accordance with Rule 8.2A of the Local Court Rules 2009 (the fixed leave period of the Local Court), normal rostered sittings of the Local Court are suspended on and from Monday 28 December 2020, and conclude on Sunday 10 January 2021. Read more.

NSW Health issues COVID-19 case location alert for Hyde Park Medical Centre, 175 Liverpool Street, Sydney
NSW Land Registry Services is asking customers who visited Hyde Park Medical Centre, 175 Liverpool Street, Sydney between Monday 24 August and Saturday 5 September to please not visit the Lodgement Office and follow advice issued by NSW Health. NSW Land Registry Services ask customers to use its online lodgement and enquiry channels where they are available. Read more.
