Local Court Chief Magistrate's Memorandum 28 – update
Law Society representatives recently discussed Chief Magistrate's Memorandum No. 28 with the Chief Magistrate’s Office. Due to resource constraints, the Court has confirmed that it will not reinstate default email appearances for mentions and short matters. However, in accordance with paragraph 3 of the Memorandum, solicitors can seek leave to appear via AVL in appropriate circumstances. Paragraph 5.2 also allows a party to apply to the Court to make alternative arrangements (which may include email appearances in appropriate cases). The Law Society will continue to advocate for improved technology and greater resources in the Local Court.
