PRESIDENT'S MESSAGE
The road to recovery and the future of law and innovation in the profession

On behalf of the state’s legal profession, I would like to congratulate the Hon. Dominic Perrottet MP, on being elected as our state’s 46th Premier. I wish the Premier and his new crisis cabinet, the COVID and Economic Recovery Committee, every success in leading NSW out of the pandemic lockdowns and reopening the economy as safely as possible. Premier Perrottet has to date made minimal changes to Cabinet so the Hon Mark Speakman SC will carry on as the state’s Attorney General. Law Society Council Election – Reminder
On Tuesday 28 September, an Invitation to Vote in the 2021 Law Society Council election was sent by email to Solicitor Members who had provided email addresses for communication purposes. The Invitation to Vote contains a unique voting link, which is personal to the recipient and must not be shared with, or forwarded to, anyone else. Members are encouraged to consider voting online to ensure your vote is received on a timely basis. Printed voting papers have also been sent to all Solicitor Members by post/DX. However, there may be delays in the delivery and return of printed materials due to the impact of COVID-19 on these services. If you are intending to return your completed ballot paper by post/DX, please do so urgently to ensure it is received at the Society prior to the close of the ballot at 2.00pm on Monday 25 October 2021. Enquiries should be directed to secretary@lawsociety.com.au.

Family Dispute Resolution Mediator Panel 2021 recruitment
Legal Aid NSW is now accepting applications from appropriately qualified and registered FDRPs to join its Family Dispute Resolution Service Panel. The recruitment is a merit-based process that will consider a number of factors including: qualifications and special expertise, location, Aboriginality, cultural diversity, availability, and the ability to undertake telephone and online mediations. Local Court sitting arrangements: Christmas and New Year period
In accordance with Rule 8.2A of the Local Court Rules 2009, normal rostered sittings are suspended on and from Saturday 25 December and conclude on Sunday 9 January 2022. Magistrates will be provided a chamber day on Friday 24 December and centralised bail court arrangements will also be extended to that date. Find out more.

eConveyancing from 11 October 2021 and Dealing with Exceptions process
A reminder that Version 2 of the Lodgment Rules commence on 11 October 2021. The Office of the Registrar General has published the Lodgment Rules exception list, on the Lodgment Rules page of its website. The Lodgment Rules exception list provides important information about those remaining small number of dealings, caveats and other instruments which can only be lodged electronically using the Dealing with Exception process. It also provides the means to lodge paper dealings that have been completed, signed and dated before 11 October 2021. A Lodgment Rules exception form will need to be submitted in the workspace if relying on a Lodgment Rule exception.

Revenue NSW - Assessment of Option arrangements
Acquisitions involving option arrangements cannot be processed through EDR and must be lodged via the eDuties portal using the ‘option’ application type.  Revenue NSW asks that all evidence (including a valuation where required) is provided in the application and for practitioners to allow sufficient time for assessment. Revenue NSW - duplicate payment of duty
Revenue NSW has advised that it is still receiving duplicate payments from the purchaser/liable party after settlement where duty has already been paid. Revenue NSW asks that if duty was paid as an ELNO disbursement, please advise your client that no further payment is required. Read more.
