The Probate List and the Family Provision List have been amalgamated into the Succession List. All Probate and family provision matters will be case managed by Justice P Hallen. There will be no changes to the current Probate or family provision listing unless the parties are notified of any change. COVID 19 - Changes to practices in the Children’s Court
The President of the Children’s Court has introduced a number of changes to practices in the Children’s Court to reduce risks to all persons in involved in Children’s Court proceedings. A notice of the changes has been published on the Children’s Court website. The Court is continuing to develop processes to enable legal professionals to appear by other means other than physical attendance. The President would like to thank the legal profession for their co-operation and the speed with which they have adapted their practices in response to the pandemic.

District Court update from Justice Price AM, Chief Judge
On and from 1 April 2020, the District Court of NSW will temporarily suspend new Judge alone trials, sentence hearings, Local Court Appeals, arraignments and readiness hearings, where the defendant is not in custody. This temporary suspension will be reviewed on 1 May 2020. The District Court will continue to hear to the extent and for as long as possible, consistent with health advice, all criminal matters where the defendant is in custody, with the exception of new jury trials which remain temporarily suspended. Local Court
The Local Court has developed a COVID-19 page, which includes the Chief Magistrate’s communications and information relating to contacting/appearing in court, bail, adjournments etc.

Temporary changes to NCAT operations
To minimise the need for parties to physically attend NCAT premises, The Hon Justice Lea Armstrong, has updated NCAT’s hearing and filing arrangements.
Filing of documents
As always, the Guardianship Division strongly encourages applications to be lodged by email. A new Procedural Direction, Procedural Direction 6 – Filing of Documents, has been issued by the President.
In further developments, the following has been implemented on top of the recent changes made to the Guardianship Division via the COVID-19 Legislation Amendment (Emergency Measures) Act 2020 No 1 :
- In that Division, the Tribunal can be constituted by two, rather than three members (with particular requirements regarding financial management orders); and
- Reasons may be given orally and the oral statement recorded, rather than in writing.
