State Revenue Legislation Further Amendment Bill 2020
The State Revenue Legislation Further Amendment Bill 2020 passed Parliament on 18 June and commences on assent. The Bill contains provisions that clarify when a trustee of a discretionary trust (including a testamentary trust) is exempt or not liable for surcharge land tax or surcharge purchaser duty. Practitioners are alerted to the transitional provisions in relation to the amendment of discretionary trusts, and the impact on wills and testamentary trusts. The Bill also makes significant changes to landholder duty. We understand that Revenue NSW will be providing guidance on how the provisions will operate in practice, and we’ll advise when this is available. READ MORE

Revenue NSW – Annual indexation of duties thresholds and base duty amounts
As part of the 2019 NSW State Budget, NSW Government introduced annual indexation of duties thresholds and base duty amounts (aligned to CPI). This impacts the general rate of duty and premium duty. The indexed amounts are now available on the Revenue NSW website and calculators. The indexed amounts apply from 1 July 2020 to 30 June 2021. See Division 3 Indexation of amounts of the Duties Act 1997.
