PRESIDENT'S MESSAGE

Opening of Law Term 2020

Ceremonies, services and events marking the official opening of law term in our state are fast approaching, including the Law Society’s the Opening of Law Term Dinner at Parliament House, Sydney on 5 February.

As is tradition, the Chief Justice of NSW, The Hon Tom Bathurst AC, will deliver the opening address at the dinner, which is always a highlight of the evening. The event allows me the opportunity, as your 2020 President, to outline what I would like to achieve this year on behalf of the state’s 35,000 solicitors – something I am looking forward to immensely. Continue reading >

2nd LAWASIA Human Rights Conference – Kathmandu, Nepal | 7 - 8 March 2020

Case management in the Supreme Court – Probate List
From 3 February 2020, all contested proceedings in the Probate List will be case managed by Justice Lindsay, the Probate List Judge. Directions before the Probate List Judge will take place on a Monday from 10am unless otherwise advised by the Court. All matters in the Probate List that are filed on or after 1 January 2020 must adhere to the Probate List Guidelines.  Parties are also required to prepare a Disclosure Statement which should be filed and served prior to the first directions hearing. The Probate List Guidelines and Disclosure Statement are published on the Supreme Court website and may be accessed here.

Revenue NSW bush fire-affected customer support
Revenue NSW has provided information regarding relief for bush fire-affected customers, including options for possible extension of payment deadlines, waiving of interest, and extension of the discretion to accept out-of-time objections. Read more

Cybercrime alert
Since the last alert the Trust Accounts Department has been notified of a further three incidents where monies have been lost through cybercrime.

State Revenue Legislation Further Amendment Bill 2019
The State Revenue Legislation Further Amendment Bill 2019 was introduced into the NSW Parliament last year, but did not pass. The Bill contains provisions regarding the imposition of surcharge land tax and surcharge purchaser duty, including in relation to trusts. Revenue NSW has announced that as the Bill has yet to be passed by the Parliament, the Government intends to extend the deadline for the amendment of discretionary trust deeds from 31 December 2019 to a later date in 2020. The Law Society is also continuing to discuss the scope of the Bill and its proposed commencement with the Government as a matter of priority.
