Membership fee survey
In November 2020, members were invited to complete an online membership fee survey administered for the Law Society by an independent research company. There was a good response rate across the membership and two lucky members also won a $450 gift card in the survey prize draw. The Law Society Council has been briefed on the survey results, which will be taken into account in setting the 2021/22 membership fee, and we are looking closely at the feedback on Law Society services and benefits. Thank you again to all members who were able to take part in the survey.

Position vacancy – ACT Integrity Commissioner   
The Speaker of the ACT Legislative Assembly invites applications for the part-time position of ACT Integrity Commissioner. The appointee must have been a Supreme or Federal Court judge; a justice of the High Court; or a lawyer of at least 10 years’ standing. A seven-year appointment term is available with remuneration and entitlements aligned to those available to Federal Court and ACT Supreme Court judges. Find out more.

New mandated eConveyancing documents from 22 March 2021
A reminder of the announcement by the Office of the Registrar General that from 22 March 2021, 29 dealings will become Required Dealings. A Required Dealing signed on or after the date on which the dealing became required, must be lodged electronically. The new Required Dealings include a Variation of lease, Consolidation/Change of by-laws, and Restriction on the use of land - see the Schedule of eDealings for the full list. In coming weeks, a Required Dealings exceptions waiver will also be published.

Personal Injury Commission updates

The Personal Injury Commission (PIC) has finalised and published the following for commencement on the PIC’s establishment on 1 March 2021:

  • The PIC Rules, which establish the practice and procedure for proceedings before the PIC,
  • The PIC Procedural Directions, which provide a detailed explanation of the PIC’s procedures,
  • The PIC Policies, which set standards of practice for the PIC and the people who use its services, and
  • The PIC Delegations, which indicate how functions under the Personal Injury Commission Act 2020, scheme Regulations and Rules will be delegated from 1 March 2021.

Claims Assessment and Medical Assessment Guidelines

The new Claims Assessment and Medical Assessment Guidelines applicable to the 1999 Compulsory Third Party (CTP) scheme have been published online:

  • Medical Assessment Guidelines version 5 – pp. 9-48
  • Claims Assessment Guidelines version 6 – pp. 49-86
These Guidelines apply to determine transitional matters (i.e. existing matters not yet resolved under the old Claims Assessment and Resolution Service (CARS) and Medical Assessment Service (MAS) system) for the Personal Injury Commission. For all other matters after 1 March 2021, the Personal Injury Commission Rules 2021 will apply.

Updates to Supreme Court’s COVID-19 procedures
The Supreme Court has updated their procedures in response to the updated Public Health Orders concerning mandatory face coverings and gathering and movement. Read more here.

Camden Local Court closure
Sittings at Camden Local Court will relocate from today, 15 February 2021. After this date, matters will commence and be finalised at Campbelltown Local Court. The new arrangement will allow for an additional two defended hearing days each month at Picton Local Court.
