PRESIDENT'S MESSAGE

NSW the first jurisdiction in Australia to legislate
far-reaching reforms to defamation laws

Earlier this month, NSW became the first jurisdiction in Australia to legislate far-reaching reforms to our nation’s defamation laws, which reflect the significant developments in digital and social media communication that have taken place since the Modern Defamation Provisions were introduced in 2005.

The overhaul of Australia’s defamation laws comes in the wake of a series of high-profile cases sparking debate about the need to balance freedom of speech with the right to protect one’s reputation. The reforms incorporated in the Defamation Amendment Act 2020 include a public interest defence for journalists, a defence for peer-reviewed material in scientific and academic journals, and a "serious harm" threshold for defamation claims aimed at keeping trivial matters out of court. Continue reading >

Memorial service for Justice Linda Margaret Ashford
Justice Ashford, appointed Acting Judge of the ACT Supreme Court in 2014, passed away on 19 June 2020. A memorial service will be held at the Village Church, Saint Aidans (Anglican), corner of Booth and Johnston Streets, Annandale on Thursday 27 August 2020 at 4.00pm. Read more.

Parramatta Local Court COVID-19 case
The Department of Communities and Justice (DCJ) has received confirmation that a security contractor who worked at Parramatta Local Court has tested positive to COVID-19.
The person last attended Parramatta Local Court on Wednesday 12 August, and the positive result was received on Saturday 15 August. As a precaution, cleaning of the courthouse took place on Sunday 16 August.
Contrary to news reports, the security guard is not a Sheriff’s Officer and was not undertaking temperature checks.
DCJ will continue to work closely with NSW Health and carry out all necessary measures to protect the safety of our staff, court users and the community.
All close contacts have been identified and are being contacted by NSW Health. As a precaution, anyone who was in attendance at Parramatta Local Court between 8.30am and 12.30pm on Tuesday, 11 August and Wednesday 12 August should watch for any symptoms. Should even mild symptoms develop, they must self-isolate and seek urgent testing for COVID-19.

The State Revenue Legislation Amendment (COVID-19 Housing Response) Act 2020 was assented on 11 August 2020. The Revenue NSW website has been updated with information which includes:
  1. Updated scheme information
  2. Application form
  3. EDR update - which includes an interim FHBAS application process
