2019 Annual Members Dinner

It was a powerful moment when Professor Megan Davis, Pro Vice-Chancellor, Indigenous and Professor of Law, UNSW, read the Uluru Statement from the Heart during her keynote address at the Law Society’s Annual Members Dinner at Sydney Town Hall last Thursday. Professor Davis delivered a moving speech during which she outlined the role of the legal profession in implementing law reform, particularly in relation to Aboriginal peoples and their rights. Professor Davis thanked the legal profession for its support of the Uluru Statement, saying its early endorsement was a major factor in shifting many views on the reforms. Continue reading >

Contract for the Sale and Purchase of Land 2019 Edition
The 2019 Edition has been released today and is available for purchase from the ECOS portal. A summary of the main changes made in the 2019 edition is available from the ECOS portal at the “About 2019 edition” icon. Residential off the plan contracts exchanged from and including 1 December 2019, must contain the “new” cooling off notice, which is included in the 2019 edition. Residential contracts which are not off the plan have until 2 June 2020 to include the “new” cooling off notice. See the Office of the Registrar General’s website and the summary of main changes for information regarding transitional provisions for the change in cooling off notice.

Conveyancing (Sale of Land) Amendment Regulation 2019
The Amending Regulation was published on 25 October 2019. Most of the provisions implementing the off the plan reforms commence on 1 December 2019, excluding important transitional provisions which have already commenced.  The Office of the Registrar General has published information about the reforms and regulation, including the new disclosure statement to be included in residential off the plan contracts from 1 December 2019.

New case management of financial applications process adopted in the Federal Circuit Court of Australia
From 4 November 2019 there will be a new process adopted in the Federal Circuit Court of Australia in Sydney for case management of financial applications. From that date, applications which seek financial orders only will be listed before a Registrar on the First Court Date and managed by a Registrar until the conclusion of the dispute resolution process. The process is based on the model successfully implemented in the Newcastle Registry. Referral to a Judge on the First Court Date will only be permitted in circumstances of genuine urgency requiring judicial determination.
