Major survey on bullying and harassment in the legal profession
One of the fundamental rights for anyone working in the legal profession, or any workplace for that matter, is that they can practise in an environment in which they are free from bullying, harassment, discrimination, vilification or victimisation. It’s disturbing to learn that, globally, one in two female lawyers and one in three male lawyers have been bullied, and that one in three female lawyers has been sexually harassed in the workplace. As part of efforts to address these alarming statistics, the International Bar Association currently is undertaking a major survey on bullying and harassment in the legal profession. The new Law Society of New South Wales Professional Standards Scheme – Commencing on 22 November 2018
All law practices should have received a hard copy information brochure about the new Scheme. An electronic copy of the brochure can be accessed here.
Key dates
Late September - all law practices will soon be sent an email providing further information about our online facility for applications for participation in, or exemption from, the 2018-2019 Scheme year.
Early October - the Law Society will open its online facility to enable applications for participation in, or exemption from, the 2018 Scheme year (22 November 2018 to 21 November 2019). The facility will be available to all law practices regardless of payment method. A hard copy of the application form will be posted in early November to those law practices which have not availed themselves of the online facility by then.
21 November 2018 - all applications to either participate or exempt must be received by 21 November 2018 . READ MORE

2018 Law Society Council Election
Nominations have closed for the 2018 Election view Candidates.
Ballot papers and voting instructions will shortly be forwarded to all solicitor members. An email invitation to vote from our external provider, BigPulse, will also be sent during the last week in September. Solicitor members with personalised email addresses recorded with the Society will again have the option of voting electronically.
To vote electronically, a unique password is populated in “Your Sign-in Name” which must not be overwritten. For security purposes, you need to enter, in “Member ID”, your Law Society Number recorded on your practising certificate (or ID card). Your personalised email cannot be forwarded on.
Please note – you may only vote once. If you choose to vote electronically, please do not submit a paper ballot as this will invalidate both the electronic and paper votes. For any queries, contact secretary@lawsociety.com.au.

Upcoming settlements with an ADI as a discharging mortgagee
Most certificates of title held by ADIs have now been converted to an electronic certificate of title (eCT). After the initial conversion of most titles held by ANZ, CBA, Westpac and NAB, most of the titles held by the remaining ADIs are being converted. Practitioners should use the free Certificate of Title (CT) inquiry search to check if an eCT has been created. If settling in paper, vendor’s solicitors will need to prepare a Request for CoRD Holder consent. READ MORE

The name of Denise Elizabeth King is removed from the local roll
On 19 September 2018 the NSW Civil & Administrative Tribunal found Denise Elizabeth King guilty of professional misconduct on ordered that her name be removed from the local roll. READ MORE

Amendment to Rule 3B of the Criminal Appeal Rules
The Supreme Court Rules Committee has approved Amendment No 1 to the Criminal Appeal Rules to enable the Court to extend the period of time within which a notice of appeal, or a notice of application for leave to appeal, may be filed. The amendment is published on the NSW Legislation Website and commences on 24 September 2018.
