Latest Decisions of Interest
The Court of Appeal has dismissed an appeal brought by the Chief Commissioner of State Revenue against orders of the Supreme Court that revoked various payroll tax assessments made by the Commissioner. The Court found that the definition of ‘employment agency contract’ in s 37 of the Taxation Administration Act 1996 (NSW) should be construed in accordance with UNSW Global Pty Ltd v Chief Commissioner of State Revenue (2006) 102 ATR 577, despite the suggested rejection of this construction in Bonner v Chief Commissioner of State Revenue [2022] NSWSC 441.
