Working with Courts during lockdown and Dementia Action Week
This past week I have continued to speak with heads of jurisdiction about the feedback we are receiving from many practitioners who are struggling to prepare matters and comply with timetables during the lockdown. We appreciate that the Courts are trying to keep the wheels of justice turning whilst complying with public health orders. However, we are being told that operating in a ‘business as usual’ environment has become particularly stressful for those practitioners who have young children, are home schooling, or don’t have an appropriate working from home environment. COVID-19 UPDATE

NSW COVID-19 statistics
NSW recorded 935 locally acquired cases of COVID-19 in the 24 hours to 8pm last night from 124,650 tests. Sadly, four deaths were recorded in that same time period and our thoughts are with their loved ones. NSW Health has reported that 23,156 vaccines were administered in the same time period. District Court statement
The District Court of NSW has announced its plan to resume jury trials in Greater Sydney, Newcastle, Gosford and Wollongong from 25 October 2021. The District Court is the largest criminal trial court in the country and around 200 trials have been vacated since the suspension of new jury trials from 28 June 2021. Jury trials have recently resumed in some regions that have come out of lockdown but remain suspended in most of NSW. Chief Judge of the District Court, Justice Derek Price AO, says the resumption of jury trials is the next step in managing a COVID-19 backlog. Read the Court’s statement here.

Restrictions ease in LGAs of concern
NSW Premier Gladys Berejiklian yesterday announced that the restrictions in local government areas of concern will start to align with other lockdown areas in Greater Sydney, as vaccination rates continue to rise. As of today, some of the eased restrictions include: no limit on the duration of outdoor exercise and recreation (previously a two-hour limit) outdoor gatherings of up to five fully vaccinated people (not including children aged 12 and under) will be allowed in a person’s LGA or within 5km of home (previously only fully vaccinated household members could gather outdoors, or up to two fully vaccinated people from different households) and shopping, exercise and outdoor recreation can be done 5km from home or within your LGA (previously only 5km from home). Nearly all restrictions in the LGAs of concern are now aligned with other lockdown areas, with the main differences being authorised worker conditions and travel permit requirements which remain in place in the LGAs of concern.

eConveyancing - Lodgment Rules Version 2 now published
Version 2 of the Lodgment Rules, as now published on the ORG website, will replace Version 1 on 11 October 2021. Version 2 introduces changes reflecting the cancellation of Certificates of Title and the requirement for 100% eConveyancing from 11 October 2021. Amongst other things, Version 2 introduces the electronic Dealing with Exception form (formerly Paper Dealing), for transactions that satisfy an exception published on the Registrar General’s website.
