Allegations regarding a residential rehabilitation facility 
NSW Attorney General the Hon Mark Speakman SC MP has written to the Law Society in relation to a number of allegations regarding a residential rehabilitation facility known as ‘The Healing House’. An excerpt of Mr Speakman’s correspondence is set out here for the benefit of solicitor members.
Bushfire Legal Aid Scheme
The Commonwealth Government has provided funding for legal assistance to NSW primary producers and small businesses (in designated LGAs) dealing with legal issues relating to the 2019/2020 bushfires. Under the Scheme, private practitioners will have access to legal aid funding to provide legal services. An Early Resolution Assistance (ERA) approval of $2,000 in professional fees is available for legal services and up to an additional $5,000 is available for disbursements. Private practitioners need to be registered for Legal Aid NSW’s Grants Online website in order to make an application. More information here.

Lawcover has experienced a sharp increase in cyber-attacks on firms and claims submitted over the Christmas break and continuing into January. Virtual courtroom protocol
A reminder that the Supreme Court has developed a fact sheet for practitioners outlining the protocols for virtual courtrooms. Virtual courtrooms are still formal courtrooms and all the usual court etiquette, protocols, procedures and restrictions must be observed. Practitioners should wait until addressed or spoken to, and preface anything they say during hearings with their name to identify themselves. For more information see the Supreme Court factsheet.

Retail and Other Commercial Leases (COVID-19) Regulation (No 3) 2020 The Retail and Other Commercial Leases (COVID-19) Regulation (No 3) 2020 replaces the Retail and Other Commercial Leases (COVID-19) Regulation (No 2) 2020 from 1 January 2021. This third regulation has some important changes regarding further lease renegotiations, eligibility and the extension of lessee protections. Commercial leases are not covered by this extension. Read more.

Revised Retail Tenancy Guide
The NSW Small Business Commissioner has published the revised Retail Tenancy Guide. The Commissioner recommends the Guide be provided as soon as, if not before, lease negotiations start, together with a copy of the proposed lease.

HomeBuilder Scheme
Revenue NSW has published information regarding the extension of the Scheme until 31 March 2021. Applications must be lodged by 14 April 2021. Read more.
