Welcome back and thank you to all who responded to our call
Welcome back and Happy New Year. I am looking forward to my term as President and engaging with our profession this year.
In wishing you all the best for 2020, I am well aware that rather than celebrating the new year, many people in NSW and around Australia were being evacuated from their homes, stranded on holidays, fighting to protect their homes and/or property, or dealing with the damage and destruction caused by the bushfires. Changes to Legal Profession Uniform General Rules
The Legal Profession Uniform General Amendment (Miscellaneous) Rule 2019, made by the Legal Services Council, commenced on 13 December 2019. It amends the Legal Profession Uniform General Rules 2015, including in relation to:
- withdrawing controlled money from the controlled money account;
- opening and maintaining files; and
- maintaining registers of files opened, safe custody documents and financial interests.
The Law Society will take an educative approach to the new requirements during the first quarter of 2020 so that law practices can review and adjust their procedures as necessary. Consistent with this approach, external examiners will provide guidance to law practices on compliance with the new requirements as part of the examination of trust records for the period ending on 31 March 2020. High Court Amendment (Electronic Filing and Other Matters) Rules 2019
The High Court Amendment (Electronic Filing and Other Matters) Rules 2019 were registered on 20 December 2020 and are available here. Download a copy of the Explanatory Statement here. The Amendment Rules amend the High Court Rules 2004 to make provision for the electronic lodgment of documents in cases started on or after 1 January 2020. The Amendment Rules also increase by 2.1 per cent, the amounts allowed in Schedule 2 of the Rules on the taxation of a bill of costs. The 2.1 per cent increase will apply in respect of all work done and services performed by solicitors after 31 December 2019.

Missed the STP deadline? Here’s what you need to know
STP is a change to the way employers report payroll, tax and super information to the ATO. All employers with 19 employees or less were required by law to report this way by 30 September 2019. Larger employers were required to report by 1 July 2018. In the Legal Services Industry, 25 per cent of small employers are still not reporting through STP and haven’t been in touch with the ATO to ask for more time. Although the deadline has passed, there are still options available for those not reporting through STP.
