Francis Forbes Society joint presentation with the Ngara Yura Committee of the Judicial Commission of NSW
This year’s joint event takes place on Tuesday 5 November 2024 at the Queens Square Law Courts Building. There will be a panel discussion exploring the history and personalities of the District Court’s Walama List. The List provides a therapeutic and holistic approach to the sentencing of eligible Aboriginal and Torres Strait Islanders. Submission of the Week: Work Health and Safety Amendment (Industrial Manslaughter) Act 2024
Earlier this year we made a submission about a proposed new industrial manslaughter offence. We supported measures to introduce industrial manslaughter provisions, and provided comments to help develop effective and appropriate legislation. The resulting Act was passed by Parliament and assented in June 2024, and the new industrial manslaughter offence commenced on 16 September 2024. The penalty framework under the legislation will send an important message that workplace safety is to be taken seriously and that failure to invest in and manage, necessary precautions is unacceptable and should have significant consequences for those responsible. FCFCOA Update: Webex Expanded Pilot
This update relates to family law and general federal law matters in the FCFCOA (Division 1) and the FCFCOA (Division 2) (the Courts).
From 11 November 2024 until further notice, each of the following virtual Court events in the NSW registries, including Albury and Lismore, and the ACT, will be conducted using the Webex platform:
- Family Law Registrars:
- First return lists
- Directions Hearing and Mentions
- Interim defended hearings
- Dispute resolution conferences
- Family Law and General Federal Law hearings before Judges
From 4 November 2024, parties and practitioners can click on the Webex link on the daily Court List and enter the virtual courtroom thereafter.

Federal Court of Australia – Next Generation Initiative Practice Note (GPN-NGI)
Chief Justice Mortimer has issued a Notice to the Profession here providing background to the Next Generation Initiative Practice Note (GPN-NGI) published on 30 October 2024. By the Practice Note, the Court encourages parties to promote the use of junior counsel in cases where two or more counsel are briefed, where it is appropriate to do so. The initiative aims to foster the development of the next generation of senior counsel by facilitating opportunities for junior counsel to gain experience in addressing the Court on substantive matters.

Administrative Review Tribunal – Practice directions, guides and guidelines
The Administrative Review Tribunal has released a note for legal and other representatives about Tribunal processes on its website: Practice directions, guides and guidelines | Administrative Review Tribunal. If you are a legal practitioner or other representative who has appeared at the former Administrative Appeals Tribunal, you may notice some changes to review processes now that the new Tribunal has commenced. Legal practitioners and other representatives appearing before the Tribunal should read the Administrative Review Tribunal Act 2024 and familiarise themselves with the Tribunal’s Practice Directions, which provide important guidance on the processes to be followed in reviews.

Australian Taxation Office (ATO) - Appointment of Second Commissioner of Taxation
Mr David Allen will be appointed as a full-time Second Commissioner of Taxation for a seven-year period beginning on 1 November 2024. Mr Allen has extensive experience in the public sector. He joined the ATO in 2010 and has been acting as the Second Commissioner since May 2024. Prior to joining the ATO, Mr Allen held senior roles in the Commonwealth, United Kingdom, NSW and local governments.
