PRESIDENT'S MESSAGE
Lawyers as volunteers

As we process the devastation of the floods in Central West NSW, our profession again demonstrates its enormous generosity and selflessness. Firms in affected regions have rallied around their communities, swiftly co-ordinating pro bono legal assistance for flood-affected people on a range of issues arising from the disaster. 

This is both through the Disaster Response Legal Service coordinated by Legal Aid and supported by the Law Society’s Pro Bono Scheme, as well as several local firms putting up their hands to help. Continue reading >

National webinars for the profession on the expansion of the Lighthouse model in the Federal Circuit and Family Court of Australia 
Two webinars are scheduled for 22 and 24 November, designed to inform the profession about how the expanded Lighthouse model and associated case management processes will work.

The expansion of Lighthouse commences on Monday 28 November 2022, and it is important for family law practitioners to be informed about the benefits to their clients.
International Day of Persons with Disabilities
In recognition of the International Day of Persons with Disabilities, the Law Society's Diversity and Inclusion Committee, in conjunction with Young Lawyers, invites you to an in-person address to be delivered by Rosemary Kayess.
We encourage legal practitioners to attend, particularly anyone interested in practical ways in which they can support and promote human rights and participation of all persons with disabilities. Find out more.

The Disabled Australian Lawyers Association (DALA) is a support network for lawyers with disabilities. Ending the COVID-19 Arrangements Policy for the Land and Environment Court of NSW
The Chief Judge has announced that the Land and Environment Court’s COVID-19 Pandemic Arrangements Policy will be revoked on 28 November 2022.
From 28 November 2022, the registrar lists on Tuesdays, Wednesdays, Thursdays and Fridays each week will be conducted in person, with Monday's list conducted by AVL. The Friday List Judge and LVC list will also be conducted in person. Read more.

CPN 025: Change in beneficial ownership
Revenue NSW has published Commissioner's Practice Note (CPN) 025 Change in beneficial ownership about change in beneficial ownership and the circumstances when certain transactions will or will not be dutiable.

First Home Buyer Choice (FHBC)
Revenue NSW has advised that from 16 January 2023 a new EDR document will be available for the processing of FHBC applications. Where a contract is entered into from 11 November 2022 and settlement is occurring before 16 January 2023, duty will need to be paid and a refund application made. Where settlement is occurring on or after 16 January 2023, from 16 January the FHBC transaction can be processed as a duties assessment through EDR. Read more.

Expansion of Lighthouse model - second and third update
Following its announcement of the expansion of the Lighthouse model from 28 November 2022, the Federal Circuit and Family Court of Australia has released:

  • A second update, focusing on Lighthouse risk screening, including Family DOORS Triage, and the process when an eligible proceeding is filed; and
  • A third update, focusing on the Evatt List.

A live webinar discussing the model has been scheduled for Tuesday 22 November 2022 3pm ACST/ 3.30pm AEST/ 4pm ACDT/ 4.30pm AEDT.
